Copyright Usage

The Client is granted the right to use the final product only. Any concepts that are not chosen and paid for may not be used. The Designer remains the owner of the copyright. The Client may not alter or modify the final design unless agreed otherwise.

Reservation of Rights

All rights are retained by the Designer, unless agreed otherwise. Any use additional to that expressly granted requires arrangement for payment of a separate fee. The Designer reserves the right to include images of the completed work on their website and portfolio.

Revisions

Revisions may be made only by the Designer at the Preliminary Design phase (before the design is finalised). Additional fees will be charged for revisions made after 3 preliminary design revisions, and for additions to the project scope.

Payment Terms

The Costs for the Services shall be set out on the Quotation. The Client shall pay each invoice submitted by the Designer within 14 days of the date of the invoice. Payment shall be made in full to a bank account nominated in writing by the Designer as stated on the Invoice. All payments must be settled following the sign off of all design work before the hand over takes place. Grant of copyright is conditioned upon receipt of final payment.

Cancellation Fee
In the event of Cancellation, the Designer will be compensated for services performed through the date of cancellation. The Client shall return all of the designed materials and any deliverables which have not been fully paid for. A project will be considered abandoned if I have not heard from you in 30 days. Upon cancellation all rights to the designs revert to the Designer.

Printing Colours
Please note that some designs may appear in different colors when printed compared to how they look on your computer screen. This variation occurs because each screen displays colours uniquely, and printing equipment can produce shades differently.

Permissions and Releases

The Client agrees to indemnify and hold the Designer harmless against any and all claims, costs, and expenses, including attorney’s fees, due to materials included in the Design at the request of the Client for which no copyright permission or privacy release was requested, or for which uses exceed the uses allowed pursuant to a permission or release. The Designer can’t guarantee that the work will be completely error-free and so they can’t be liable to the Client or any third-party for damages, including lost profits, lost savings or other incidental, consequential or special damages following said error.
